1. Introduction
These terms of use govern the purchases and use of the website www.chronofix-tiku.eu by the user and constitute a contract between the latter and Carpe Diem watches and jewelry of major brands by Schiavone Marino Antonio (hereinafter referred to as "Carpe Diem"), registered number in the register of companies of Milan MI-1942374, Via Vespri Siciliani 19, 20146 Milan (Italy), VAT number IT-07196490960, owner of the website and the Tiku trademark.
By making a purchase and using this website, the user agrees to these terms of use.
Please ensure you have read and understood the following conditions when using the site.
2. Service Object
These terms govern the provision of the service of watch repair, maintenance and servicing carried out by Carpe Diem via correspondence (shipping and return by courier).
3. Request Procedure
- The customer can start the repair process by accessing the web portal www.chronofix-tiku.eu, where they can purchase a prepaid shipping label to send their watch to the Carpe Diem service center.
- After receiving the watch, Carpe Diem will examine it with its specialized technicians, assessing the damage with maximum precision and transparency, and will begin the repair automatically or with the necessary prior written acceptance of the quote, as provided for in point 6 of these contractual conditions.
- The return of the repaired product is done via tracked courier, chosen by Carpe Diem, at its own expense, even in case of non-acceptance of the repair estimate.
4. Order Confirmation
Once the order is received, a purchase confirmation will be sent to the customer's email address. It is very important to enter the correct address at the time of ordering.
We recommend saving this email for easier future contact with customer service.
The purchase confirmation includes the unique order number identifying the purchased label and the customer's shipping data.
The object of the customer's order is the purchase of a prepaid shipping label, which will be provided by email within 24h/48h after payment, using the provided data. The label must be used by the User to send the watch to the Carpe Diem service center.
5. Payment of Shipping Label
The website accepts several payment methods:
- PayPal
- Credit card
- Bank transfer
The list of accepted payments should be considered illustrative, not exhaustive. Carpe Diem reserves the right to add and/or remove other payment methods at its sole discretion.
6. Shipping and Liability
The Customer purchases only one shipping label at the time of order. This label will be sent by email within 24h/48h after payment receipt and will be used to send the watch to the Carpe Diem service center. The buyer may, at their discretion, purchase an insurance policy, available among different coverage limits, to protect the product from possible thefts, losses and/or damages caused by the courier during transport. Carpe Diem cannot be held responsible in any case for any thefts, losses and/or damages occurring to the Customer's package before its delivery to the repair center. Carpe Diem will also not be held responsible for any thefts, losses and/or damages to the package caused by the use of inadequate packaging by the User.
In case of thefts, losses and/or damages caused by the courier during transport, no refund will be issued to the Customer in case of non-subscription of the optional insurance coverage and payment. The User shall only be entitled to a refund of the shipping label cost, granted by Carpe Diem within the timeframes provided by the terms of transport of the used courier.
The return of the repaired product is always free, at Carpe Diem's expense; even in case of repair quotes exceeding 60.00 (sixty) euros not approved by the Customer.
7. Shipping Insurance
The Customer, purchasing the shipping label, may, at their choice, subscribe to an insurance coverage for a fee based on different maximum limits provided. The insured amount represents the maximum coverage value of the item, it will be the Customer's responsibility to prove to Carpe Diem the actual value of the product in case of need, with the opening of a theft and/or loss report with the used carrier. The insurance coverage refers to the value of the used item, not that of a new product.
In order to obtain a refund in case of theft and/or loss of the package, the Customer must present an affidavit and the sales invoice (PayPal receipt and/or from other selling platforms, bank transfer, receipt or purchase invoice) to justify the value of the shipped watch.
- The coverage operates upon occurrence of a damaging event provided for in the General Terms of Transport of the used carrier.
- These provisions are to be considered in addition to, not instead of, what is provided in the General Terms of Transport of the used carrier.
- The paid insurance coverage on the value of goods includes the value of lost, damaged or stolen items, for a maximum total value of 500.00 (five hundred) euros.
- The insurance coverage mentioned above does not include transport costs, even if incurred or to be incurred in cases of delay in pickup or delivery.
- The refund will only occur upon presentation of documentation proving the value of the goods, receipt or purchase invoice with a date less than 60 days from the sending date; or, in the absence of this, price list, sales invoice (PayPal receipt, eBay and/or other selling platforms, bank transfer, previous repair invoice, etc.).
- It is exclusively the Customer's responsibility to prove the value of the shipped item; Carpe Diem cannot be held responsible for the non-refund by the used carrier, in case the latter does not consider sufficient and/or exhaustive the documentation provided by the User to justify the value of the shipped item.
8. Maximum Package Size and Weight
Our shipping label allows sending a medium-small sized package, reserved for sending small, non-heavy items (such as a wristwatch). The standard measurement to refer to is a box of 16 cm x 16 cm x 16 cm (l x h x p) with a maximum weight of 1.00 kg. Slightly different packaging sizes can be used, but it is recommended not to exceed the above-mentioned measurements.
To keep the package weight down, it is not necessary to send the individual watch box, as it is sufficient to package and protect it appropriately using suitable packaging material. It is possible to ship multiple pieces with the same label, provided the dimensional and weight limits mentioned above are respected.
Carpe Diem reserves the right to charge the Customer additional shipping costs due to sending oversized and/or heavier packages than those specified in these contractual conditions. We invite the Customer to contact Carpe Diem directly before shipping if a larger packaging is needed.
9. Tariffs and Billing
The object of the Customer's payment at the time of order confirmation is only and exclusively a prepaid shipping label, intended for sending their watch to the Carpe Diem repair center. The price of the label does not represent an advance payment against the repair cost and depends on the Customer's country: it can be viewed after selecting the User's country during checkout and online form completion.
The Customer may request a refund of the purchased label within 10 (ten) calendar days from the payment date, provided it has not been used: no refund will be issued in this case or if the cancellation request is late by the Customer (more than ten calendar days after payment).
Cost of single repair:
- All repairs up to a maximum expense of 60.00 (sixty) euros will be performed automatically by Carpe Diem, without requiring prior approval from the Customer.
- Work exceeding 60.00 (sixty) euros must instead be pre-approved by the customer via email within a maximum of 7 (seven) calendar days, after which the quote will be considered as not approved and the product returned to the Customer as not repaired.
In both cases, the Customer will receive a written estimate with an approximate timeline for work.
The repair cost is to be considered per single watch shipped; if the Customer requests assistance and repair of multiple pieces, the same contractual conditions will apply to each watch.
The tariffs applied always include the Italian VAT of 22%, in accordance with applicable regulations. Companies based within the EU can request B2B invoicing without VAT with reverse charge. The request must be made in writing via email or as a note at the time of order confirmation for the shipping label.
Carpe Diem's repair service is not currently offered to customers residing in countries outside the EU.
10. Repairing Multiple Watches
The Customer can send multiple watches using the same shipping label. No additional charge is applied to the label cost, provided a box that respects the maximum weight and dimensions indicated in point 8 of these contractual conditions is used for sending.
It will be sufficient to indicate the number of pieces for which assistance is requested in the appropriate field of the online form during checkout.
11. Processing Times
Carpe Diem commits to performing repair work in the shortest possible time. It is not always possible to estimate repair timelines, as they may vary depending on the complexity of the intervention and/or availability of spare parts. An approximate estimate will still be sent to the customer by email together with the written estimate. In case of significant delays, the Customer will be informed promptly.
12. Payment for Repair
The payment for the repair must be made according to the following methods:
- PayPal
- Credit card
- Bank transfer
Carpe Diem reserves the right to add and/or remove other payment methods.
The payment request is sent to the Customer via email using the method chosen by them among those offered by Carpe Diem. No payment is requested before the repair is completed.
Any estimate for work exceeding 60.00 (sixty) euros is always free and will never be subject to a payment request, even as an advance on the repair cost.
The watch will be sent back to the Customer only after payment has been received.
13. Warranty on Intervention
All repair interventions are covered by a legal warranty of 12 (twelve) months from the date of re-delivery, limited to defects related to the performed intervention.
The warranty does not cover damages resulting from impacts, water infiltration, improper use or interventions carried out by third parties after the repair. Similarly, damages or defects arising from normal wear of the product, as well as its normal use, are not covered.
14. Right of Withdrawal
In accordance with article 59, paragraph 1, letter a) of the Consumer Code, the right of withdrawal does not apply to services already performed following the acceptance of the quote. The Customer can withdraw their request and request the return of the watch before the start of the repair and in any case no later than 3 (three) calendar days after the written approval of the quote (for repairs exceeding 60, sixty euros) or the written communication via email of the quote (for automatic repairs under 60, sixty euros).
As established in point 6 of these contractual conditions, repairs below 60.00 (sixty) euros do not require the Customer's written approval of the quote and, therefore, if already started, cannot be subject to withdrawal.
15. Liability and Limitations
Carpe Diem is only liable for damages directly attributable to negligence or error in the service provided, within the limits of the intervention value. In no case can a compensation be requested exceeding the commercial value of the watch, considering even its condition.
Carpe Diem's liability for delivery errors is limited to existing sales conditions. Carpe Diem assumes no direct or indirect responsibility, including but not exclusively, incompatibilities, delivery delays, downtime, data loss, additional work or other economic damages.
16. Personal Data Processing
The Customer's personal data will be processed in accordance with Regulation EU 679/2016 (GDPR) and used exclusively for purposes connected to the execution of the service.
17. Force Majeure
Carpe Diem is exempt from any liability for damages and/or other sanctions related to the performance of this contract, in case it is prevented, hindered or delayed by circumstances independent of its will.
Such causes falling under the so-called "force majeure" include, by way of example and not exhaustively: new legislation, changes to existing legislation, fires, floods, labor unrest, prohibitions, restrictions, sabotage, poor transportation or weather conditions, delivery interruptions by suppliers and all cases in which the activity is exposed to criminal acts that compromise its proper functioning.
18. User Content
The website www.chronofix-tiku.eu may include user-generated content, such as from social media applications.
Carpe Diem holds no ownership rights over such content (images, photos, videos, etc.) and assumes no legal responsibility for them.
For example, if copyright or any other right is suspected to be violated, or if someone could feel offended by it in any way, please contact customer service.
19. Intellectual Property Rights
Carpe Diem is an independent business, not associated or affiliated with any of the companies owning the trademarks present on its website. All logos are used exclusively for descriptive purposes and are registered trademarks belonging to their legitimate owners.
Any use of the site or its content, including copying or archiving all or part of it, except for personal non-commercial use, is prohibited without the written consent of Carpe Diem.
20. Interruption
Carpe Diem reserves the right to close and/or suspend the use of the website www.chronofix-tiku.eu by the User at its discretion, if, for example, it suspects a violation of these terms of use. This interruption can occur without prior notice.
21. Applicable Law and Competent Forum
These conditions and the use of the website www.chronofix-tiku.eu by the User are governed by Italian and European Union law. To the extent permitted by law, the Milan court will have exclusive jurisdiction regarding any dispute arising from these terms of use and the use of the website by the User, in accordance with Carpe Diem's right to sue a User in their place of residence.
22. Changes
Carpe Diem may review these terms of use from time to time. Whenever the User uses the repair service by purchasing a shipping label on the website www.chronofix-tiku.eu, the applicable general sales conditions will apply.
